Security deposits in Florida
Florida law sets the rules for getting a deposit back. Under section 83.49 of the Florida Statutes, a landlord who makes no claim on the deposit must return it within 15 days after you move out; one who intends to keep any of it must send written notice within 30 days. For leases signed or renewed since July 1, 2023, section 83.491 also lets landlords offer a fee in place of a deposit. The landlord must tell you in writing whether that fee is refundable, so compare the total over your lease before choosing it.
